1. Agreement
These Terms of Service ("Terms") govern your access to and use of FSOT Daily (the "Service"), including its websites, mobile applications, and related software, content, and communications (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@pathtoforeignservice.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
4. Subscriptions & billing
Paid plans are billed in advance on a monthly or annual basis through the Apple App Store or Google Play Store and renew automatically until cancelled. You may cancel at any time from your device's subscription settings; cancellation stops future renewals but does not refund the current period.
Refunds are handled by Apple or Google in accordance with their respective refund policies. If you need help with a billing issue, contact us at support@pathtoforeignservice.com and we'll do our best to assist.
Prices are listed in U.S. dollars and exclude taxes, which may be added where applicable. We may change prices on a forward‑looking basis with reasonable notice; existing paid periods are not affected by price changes.
5. License & acceptable use
Subject to these Terms and your subscription status, we grant you a limited, non‑exclusive, non‑transferable, revocable license to use the Service for your personal, non‑commercial study purposes.
You agree not to: (a) copy, scrape, redistribute, sell, or sublicense Service content; (b) reverse engineer, decompile, or attempt to derive source code; (c) use the Service to develop a competing product; (d) circumvent rate limits or access controls; (e) upload malicious code; or (f) use the Service for any unlawful purpose.
6. Content & ownership
All questions, explanations, articles, branding, software, and other materials provided through the Service are owned by Path to Foreign Service, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you submit (e.g., support requests, feedback) but grant us a worldwide, royalty‑free license to use it to operate and improve the Service.
7. No guarantees
The Service is a study and preparation tool. We do not guarantee any specific score on the Foreign Service Officer Test, passage of the test, employment, or selection into the Foreign Service. Outcomes depend on many factors outside our control, including the test itself, government hiring processes, and your own preparation and performance.
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.
8. Independent resource
FSOT Daily is an independent study product. It is not affiliated with, endorsed by, or sponsored by the U.S. Department of State or any government agency. References to the Foreign Service Officer Test, the Department of State, or related programs are nominative and used solely to describe the Service's subject matter. All trademarks are the property of their respective owners.
9. Limitation of liability
To the maximum extent permitted by law, Path to Foreign Service, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or USD $50, whichever is greater.
10. Changes
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Pierce County, Washington, and you consent to the personal jurisdiction of those courts.
